Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Gontobbo Pilot mobile application, website, and related services (collectively, the "Service") as a driver (referred to as a "Pilot"). By registering, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions
  • "Company" refers to IQuix Limited, the owner and operator of the Service.
  • "App" refers to the Gontobbo Pilot mobile application and related platforms.
  • "Pilot" / "Driver" / "You" refers to an independent transportation provider who has subscribed to the Company’s services and uses the App to receive ride requests.
  • "Passenger" refers to any user who requests or uses transportation services through the App.
  • "Ride" refers to transportation services requested through the App and accepted by a Pilot.
  • "Subscription" refers to any paid or unpaid plan that allows Pilots to access the Service.
2. Eligibility and Requirements

To register and operate as a Pilot, you must:

  • Be at least 18 years old (or the legal age of majority in your jurisdiction).
  • Hold a valid driving license applicable to the vehicle type you operate.
  • Own, lease, or have lawful access to a roadworthy vehicle.
  • Maintain valid vehicle registration, fitness certification, permits, and insurance as required by law.
  • Provide accurate, complete, and up-to-date information and documents upon request.

The Company reserves the right to verify documents and suspend or terminate access if requirements are not met.

3. Independent Contractor Status
  • Pilots operate as independent contractors and not as employees, partners, agents, or representatives of the Company.
  • Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.
  • Pilots are solely responsible for their own taxes, licenses, permits, fuel, maintenance, insurance, and operational expenses.
4. Account Registration and Security
  • You must create and maintain an active Pilot account to access the Service.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • All activities conducted through your account are your sole responsibility.
  • Account sharing or transfer is strictly prohibited.
5. Nature of the Service
  • The Company provides a technology platform that enables Pilots to connect with Passengers.
  • The Company does not provide transportation services and does not control how Pilots perform rides.
  • Pilots are free to accept or reject ride requests, subject to performance standards outlined in the App.
6. Subscriptions, Fees, and Payments
  • Pilots may be required to subscribe to a Service plan to access ride requests.
  • Subscription fees, commission structures, or service charges will be disclosed in the App.
  • All fees paid are generally non-refundable unless required by law or expressly stated otherwise.
  • The Company may modify subscription plans, pricing, or commission structures with prior notice through the App.
7. Ride Acceptance and Completion
  • A Ride is formed only when you accept a Passenger’s request through the App.
  • You agree to complete accepted Rides professionally, safely, and lawfully.
  • You shall not unreasonably cancel Rides after acceptance except for safety or lawful reasons.
  • You must follow all applicable traffic laws and regulations during Rides.
8. Pilot Conduct and Responsibilities

You agree to:

  • Treat Passengers with respect and courtesy at all times.
  • Maintain your vehicle in clean, safe, and roadworthy condition.
  • Not engage in abusive, threatening, discriminatory, or unlawful behavior.
  • Not operate under the influence of alcohol, drugs, or substances that impair driving ability.
  • Not request cash payments outside the App unless explicitly permitted.
  • Not misuse the App, Passenger data, or Company systems.
9. Safety and Incidents
  • You are solely responsible for the safe operation of your vehicle.
  • In case of accidents, injuries, or emergencies, you must immediately contact local emergency services and comply with legal reporting requirements.
  • The Company does not provide insurance coverage unless explicitly stated in writing.
  • You will be rewarded for your efforts to return any lost item during a ride according to the company policies.
10. Ratings and Performance
  • Passengers may rate and provide feedback on your services.
  • The Company may use ratings, acceptance rates, cancellation rates, and complaints to evaluate performance.
  • Consistently poor performance may result in suspension or termination of access to the Service.
11. Device, Data, and Connectivity
  • You are responsible for procuring and maintaining a compatible smartphone and internet connection.
  • The Company is not responsible for data charges or connectivity issues.
12. Intellectual Property and Data Use
  • All intellectual property related to the App remains the property of the Company.
  • You are granted a limited, non-exclusive, non-transferable license to use the App solely for providing Rides through the Service.
  • Passenger data may only be used for completing Rides and must not be stored, shared, or misused.
13. Privacy

Your use of the Service is subject to the Company’s Privacy Policy, which explains how personal and operational data is collected, used, and shared.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available." The Company makes no warranties regarding demand, earnings, availability, or uninterrupted access.

15. Limitation of Liability

To the maximum extent permitted by law:

  • The Company shall not be liable for indirect, incidental, special, or consequential damages.
  • The Company’s total liability arising out of or related to the Service shall not exceed the total subscription or service fees paid by you in the three (3) months preceding the claim.
16. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, losses, liabilities, or expenses arising from:

  • Your provision of Rides;
  • Your violation of these Terms or applicable laws; or
  • Any accident, injury, or damage involving your vehicle.
17. Suspension and Termination
  • You may stop using the Service at any time.
  • The Company may suspend or terminate your access immediately for violations of these Terms, safety concerns, fraud, or legal non-compliance.
18. Governing Law and Dispute Resolution
  • These Terms shall be governed by the laws of [Jurisdiction].
  • Any disputes shall be resolved exclusively in the courts of [Jurisdiction], unless otherwise required by law.
19. Changes to These Terms

The Company may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account and use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Account Registration and Security
  • You must provide accurate, complete, and up-to-date information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • The Company reserves the right to suspend or terminate accounts for fraudulent, abusive, or unlawful behavior.
4. Nature of the Service
  • The Company provides a technology platform that connects Passengers with independent Drivers.
  • The Company does not provide transportation services and is not a transportation carrier.
  • Drivers are not employees, agents, or representatives of the Company.
5. Ride Requests and Acceptance
  • Ride requests are subject to Driver availability.
  • A ride is formed only when a Driver accepts your request.
  • Estimated arrival times, routes, and fares are estimates only and may vary due to traffic, weather, or other factors.
6. Fares, Payments, and Fees
  • Fares are calculated based on factors such as distance, time, demand, and applicable fees.
  • You agree to pay all applicable fares, tolls, taxes, surcharges, and fees.
  • Payments are processed through the App using your selected payment method.
  • The Company may charge cancellation fees if you cancel a ride after a Driver has accepted it.
  • All payments are generally non-refundable unless required by law or expressly stated otherwise.
7. Cancellations and No-Shows
  • You may cancel a ride in accordance with the cancellation policy displayed in the App.
  • Failure to appear at the pickup location within a reasonable time may result in a no-show fee.
8. Passenger Conduct

You agree to:

  • Treat Drivers with respect and courtesy.
  • Comply with all applicable laws and regulations.
  • Not engage in abusive, threatening, discriminatory, or unlawful behavior.
  • Not damage the Driver's vehicle; cleaning or repair fees may apply if damage occurs.
  • Not request or engage in illegal activities during a ride.
9. Safety
  • You are responsible for using reasonable judgment and caution when using the Service.
  • The Company does not guarantee the safety, quality, or legality of any Driver or Ride.
  • In case of an emergency, contact local emergency services immediately.
10. Ratings and Feedback
  • You may provide ratings and feedback regarding Drivers.
  • Feedback must be honest and not defamatory, abusive, or misleading.
  • The Company may use feedback to improve the Service.
11. Promotions and Credits
  • Promotional offers, discounts, or credits are subject to additional terms.
  • Promotions may be modified or discontinued at any time.
  • Credits have no cash value and may expire.
12. Intellectual Property
  • All content, trademarks, logos, and software associated with the App are owned by or licensed to the Company.
  • You may not copy, modify, distribute, or reverse engineer any part of the Service without permission.
13. Privacy

Your use of the Service is subject to the Company’s Privacy Policy, which explains how your personal data is collected, used, and shared.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available." The Company makes no warranties, express or implied, regarding the reliability, availability, or suitability of the Service.

15. Limitation of Liability
